This Privacy Policy applies to both methods. This Privacy Policy applies to all CyberPower brands, products, and services that link to this Privacy Policy or do not have a separate Privacy Policy.

1. INFORMATION WE COLLECT

The information we gather about you depends on the context. By and large, it’s information theat you provide to us about you that can personally identify you — either on its own or when combined with other information. We also collect information during the use of our services and from other sources.

In summary, CyberPower may collect the following general classes of information, as more fully described below: personal information (including name, title, phone, email and other business contact information), commercial information (like product purchase information), internet access and use activity information (like log files and cookies).

Like most businesses, we use a customer relationship management system to store personal information about our business contacts.

To provide better service for you, we collect information in the following ways:

A. Information you voluntarily provide us.

You may choose to sign up for an account to use our website or apps. To create an account, you may be asked for your basic contact information, such as, but not limited to: name, address, phone number, email address, company, job title, products you register, and product serial numbers, passwords, browser settings, and IP address. You may also choose to provide CyberPower you’re your basic contact information for: technical support requests, buying/sales tools, resource downloads, and contact forms. You may want to give us your name and contact information to communicate with you, to order or receive support regarding a product, to process an order, to register for a service, to provide you with a subscription, or to do business with us if you are a supplier or a business partner.

Reaching out to us through other means than the website, such social media, may lead to the collection of your information as well which may be associated with that social media profile.

We may collect information about your activities during your visit in order to personalize your website experience, such as recording your preferences and settings, and to collect statistics to help us improve and further develop our websites, products and services.

B. Registration information

When you sign up for a warranty registration, or create an account we collect personal identifiers such as your contact information, including your name and email address, and account credentials. We may also ask you to create an account name. Once you’re registered, we assign you a unique ID number. This ID number helps us recognize you when you’re signed in.

If you register for an event or conference, we might ask for additional information (e.g., your company name, your job title or your dietary restrictions). Some events and conferences may have different or additional privacy policies and terms and we recommend that you review those before you register.

C. Information we collect automatically when you use our services.

Log files
Like many other websites, cyberpowersystems.com makes use of log files. The information inside the log files includes internet protocol (IP) addresses, type of browser used, Internet Service Provider (ISP), date/time stamp, referring/exit pages, and number of clicks. CyberPower uses this information to analyze trends, administer the site, track movement around the site, and gather demographic information. IP addresses, and other such information, are not linked to any information that is personally identifiable.

CyberPower may collect information about your computer, including your IP address (including information deriving from your IP address such as your geographic location), operating system, browser type, version and language, access time, duration of access, and referring website addresses. CyberPower may also collect information about the pages you view within our sites, the time you spent on each site and other actions you take while visiting our website. When you access our website without signing in, we will still collect some of this personal information in order to enable the websites to function properly.

CyberPower’s Website is not directed at children. As defined by local law, this website does not target children under 13 years of age, nor does CyberPower have knowledge that children access its website. CyberPower does not knowingly collect information from children. We encourage parents and guardians to take an active role in their children’s online and mobile activities and interests.
Cookies and Web Beacons

cyberpowersystems.com does use web technologies including scripts, tags, Local Storage, transport beacons, and “cookies” to store information about visitor’s preferences, to record user-specific information on which pages the user accesses or visits, and to customize the webpage content based on information the visitor sends via their browser.

2. CHILDREN’S PRIVACY

Our website and services are not directed at children under the age of 14. We do not use our website to knowingly solicit Personal Information from or market to children under the age of 14, or the relevant minimum age under applicable local legal requirements, except as permitted under applicable law.

FORMATION

• Registering an account on CyberPower websites or apps: Registering a purchase of our product for proof of purchase and warranty claim purposes, and related to product support.
• Customer service: Respond to your question and support your needs, communicate with you, deliver product and information to you, and return merchandise authorization (RMA)
• Marketing activities: Marketing our products, services, training courses, events and upcoming changes, improvements, or promotions; conduct surveys and customer services; issue you newsletters or other communications about products or services; notify you of upcoming events. You can opt out, or unsubscribe, from marketing communications at any time using the “Unsubscribe” link in each newsletter or communication.
• Legitimate commercial interests: Managing our relationship to clients and consumers; Notify you of terms and policy changes; handle or solve legal disputes, for regulatory investigations and compliance, or to enforce the terms of use in our websites or services; communicate with you about business you may have with CyberPower; Marketing; maintaining our IT network and website. We will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy.

CyberPower processes personal information on our servers in many countries around the world. We may store and process your personal information on a server located outside the country where you live.

Your information will be under appropriate safeguards with encryption or pseudonymization (depersonalization).

4. SHARING YOUR INFORMATION

A. For commercial, processing or compliance reasons

CyberPower may share your information with its affiliates, including the companies’ employees, our trusted agents, representatives, vendors, organizations, consultants and other service suppliers who need to access your information to carry on our behalf including the development of new products, marketing, and CyberPower’s general commercial operations. Information may also be used for internal (audit/compliance) investigations. For a business transaction (such as merging or selling assets), we may also disclose your information.

All such third parties will be under an obligation to maintain the security and confidentiality of your information and to process your information only in accordance with our instructions.

B. For legal reasons

CyberPower may, in compliance with applicable law, regulation, ordinance, license, operating agreement, or legal process, disclose your information to protect ourselves against liability, to respond to legal orders- including judicial processes, legitimate requests, warrants, or equivalent by law enforcement officials or a competent authorities- to investigate fraud or other wrongdoing, to comply with applicable law, or to protect our legitimate interests.

We may also, in compliance with applicable law, disclose your information to enforce or apply the terms and conditions applicable to our services, or to protect the rights, property, and safety of CyberPower, our users, or others.

In the situations described above, the recipient of your information may be located in a jurisdiction that may have different standards of data protection compared to the laws in your home jurisdiction.

5. INFORMATION SECURITY AND ACCURACY

We intend to protect your personal information and to maintain its accuracy. CyberPower implements reasonable physical, administrative and technical safeguards to help us protect your personal information from unauthorized access, use and disclosure. We also require that our suppliers protect such information from unauthorized access, use and disclosure.

6. DATA RETENTION

CyberPower will retain your personal information for as long as is required to fulfill the purposes for which the information is processed or for other valid reasons to retain your personal information (for example to comply with our legal obligations, resolve disputes, or enforce our agreements).This may be a period of time necessary to maintain a business record or for longer periods where required by law, regulation or professional standards, as well as to exercise and defend our legal rights. Your registration information will be retained for as long as your account is active or as needed to provide you services.

7. TRANSPARENCY AND CHOICE

CyberPower encourages you to keep your information accurate and up to date.

People have different privacy concerns. We retain your information while your account remains active. You may manage your account by logging into your account. If you want to delete your account, please email us at data@cyberpower.com. Please note that if you delete your account, or select not to provide us with some types of information, your request or needs can’t be responded to in a timely manner.

8. DATA PRIVACY FRAMEWORK AND CROSS BORDER TRANSFERS OF DATA

CyberPower adheres to the EU-U.S. Data Privacy Framework, the UK Extension to the EU-U.S Data Privacy Framework, and the Swiss-U.S. Data Privacy Framework as set forth by the U.S. Department of Commerce.

We are part of a global network of companies and we use third parties located in other countries to help us run our business. As a result, personal information may be transferred outside the countries where we and our clients are located. This includes transfers to countries outside the European Economic Area (“EEA”) and to countries that may not have laws that provide the same degree of protection for personal information as your home country. In accordance with applicable legal requirements, we take appropriate measures to facilitate adequate protection for any information so transferred.

Where we transfer personal information outside of the EEA to a country or framework not determined by the European Commission as providing an adequate level of protection for personal information, the transfers will be under an agreement which covers European Union requirements for such transfers, such as standard contractual clauses.

9. INFORMATION DISCLOSURE.

Other associated business entities. We will disclose data to our parent and subsidiary business entities. We store personal information on our, or other, company servers in the United States, EU and Asia.
Third party organizations that provide applications/functionality, data processing or IT services to us. We use third parties to support us in providing our services and to help provide, run and manage our internal IT systems – for example, providers of information technology, cloud-based software-as-a-service, identity management, website hosting and management, data analysis, data back-up, security and storage services. The servers powering and facilitating that cloud infrastructure are located in data centers around the world, and personal information may be stored in any one of them.
Auditors, professional advisors and insurers. We engage auditors and other professional advisors, for example, law firms, as necessary to establish, exercise or defend our legal rights and obtain advice in connection with the running of our business. Personal information may be disclosed to these auditors and other advisors as necessary in connection with the products and services they have been engaged to provide. We also have a number of business insurance policies in place and we may need to disclose personal information to the insurer, for example, in the event of a claim.

For the purposes of the EU General Data Protection Regulation (GDPR), the controller of your personal information is Cyber Power Systems (USA), Inc., unless indicated otherwise. Where Cyber Power Systems (USA), Inc. or a subsidiary it controls (not established in the European Economic Area (EEA)) is required to appoint a legal representative in the EEA, the representative for all such cases is data@cyberpower.com.

You may have additional rights pursuant to your local law applicable to the processing. For example, if the processing of your personal information is subject to the EU General Data Protection Regulation (“GDPR”), and your personal information is processed based on legitimate interests, you have the right to object to the processing on grounds relating to your specific situation. Under GDPR you may also have the right to request to have your personal information deleted or restricted and ask for portability of your personal information.

CyberPower is not the controller in situations such as:
• Personal information processed in connection with a contractual relationship, or with entering into a contractual relationship with a specific CyberPower affiliate. In this case the controller of personal information is the contracting company, which is the legal entity with which you or your employer have, or will have, the contract.
• Personal information collected on the physical site or location of an CyberPower parent or subsidiary. In this case that entity is the controller of the personal information.

In supplement to the foregoing, for California residents and solely to those residents or individuals who reside in the State of California or to whom these same rights apply under applicable law the following additional terms apply. Cyber Power Systems (USA), Inc. is the controller of data processed in connection with use of CyberPower’s website and services globally, except where it may be a joint controller with another CyberPower affiliate company or entity.

This Privacy Policy applies to all of the services offered by CyberPower and its affiliates, but excludes services or products provided by others. This Privacy Policy also does not apply to other websites, apps, services or products you visit through links from CyberPower websites or mobile apps.
